HealthWatch is a meal recommendation tool powered by AI. It looks at the health conditions and medications you enter and suggests recipes designed to support your general nutrition and reduce the risk of common food-drug conflicts. It is not a medical product. It cannot replace your doctor, pharmacist, or registered dietitian. Nothing it tells you should be used to change, stop, or adjust your medications or medical treatment. If you have a serious health condition, are pregnant, are under 18, or are on high-risk medications like blood thinners or chemotherapy, this tool is not for you. In an emergency, call 911.


1. Not Medical Advice — Absolute Disclaimer

1.1 — HealthWatch does not provide medical advice, diagnosis, or treatment of any kind. All outputs generated by this tool — including meal suggestions, nutritional guidance, and food-drug conflict alerts — are for informational and general wellness purposes only.

1.2 — No physician-patient relationship is formed through use of this tool. No licensed physician, registered dietitian, pharmacist, or any other healthcare provider reviews, approves, or supervises any individual recommendation generated by HealthWatch in real time or after the fact.

1.3 — The information provided by HealthWatch does not substitute for professional medical judgment. You should not use it as the basis for any medical decision.


2. Consult Your Healthcare Provider

2.1 — By using HealthWatch, you confirm that you have consulted, or will consult, a qualified healthcare professional before acting on any recommendation this tool provides.

2.2 — Depending on your situation, you should speak with one or more of the following professionals before making any dietary changes based on this tool: your primary care physician, regarding your overall health and medical conditions; your pharmacist, regarding drug-food interactions specific to your medication regimen; a registered dietitian or licensed nutritionist, regarding dietary planning suited to your health needs.

2.3 — You must not stop, reduce, increase, or otherwise adjust any medication based on meal recommendations from HealthWatch. Medication management is the exclusive domain of your licensed prescriber and pharmacist.

2.4 — If a meal suggestion from HealthWatch conflicts with instructions given to you by your healthcare provider, follow your healthcare provider's instructions.


3. Drug-Food Interaction Limitations

3.1 — HealthWatch attempts to flag potential food-drug interactions based on publicly available data sources, including the OpenFDA database. However, HealthWatch cannot guarantee detection of all drug-food interactions, and users must not rely on this tool as a comprehensive or definitive source of drug interaction information.

3.2 — Drug-food interactions are complex, individualized, and context-dependent. Whether a specific interaction occurs — and how severe it may be — depends on factors including but not limited to: your specific dosage, the timing of your meals relative to medication, your individual metabolism, kidney and liver function, co-existing medical conditions, and other medications you are taking simultaneously.

3.3 — The data sources used by HealthWatch, including the OpenFDA API and any other third-party databases, may be incomplete, contain errors, or reflect outdated research. Data may not account for your specific drug formulation, generic versus brand-name variants, or compounded preparations.

3.4 — The following are examples of serious drug-food interactions that are well-documented in medical literature and that this tool may not fully or accurately capture: Warfarin and vitamin K-rich foods (e.g., leafy greens); MAOIs and tyramine-rich foods (e.g., aged cheeses, cured meats, fermented products); Statins and grapefruit or grapefruit juice; SSRIs and certain herbal supplements (e.g., St. John's Wort). This list is illustrative only. There are many other documented and undocumented interactions not captured here.

3.5 — You acknowledge that the absence of a warning from HealthWatch does not mean an interaction does not exist.


4. User-Submitted Health Data — Accuracy Disclaimer

4.1 — HealthWatch's outputs depend entirely on the health information and medication data you submit. The tool has no independent ability to verify, supplement, or validate any information you provide.

4.2 — HealthWatch is not responsible for any harm, inaccuracy, or inappropriate recommendation resulting from health data that is incomplete, incorrect, outdated, or misrepresented — whether intentionally or unintentionally.

4.3 — You may not know, or may incorrectly recall, the full name, formulation, dosage, or complete interaction profile of your medications. This limitation directly affects the reliability of any output HealthWatch produces.

4.4 — The following categories of drug use fall outside the intended scope of this tool, and HealthWatch expressly disclaims any ability to account for them: off-label drug use; compounded medications; investigational or clinical trial drugs; medications obtained outside licensed pharmacy channels.


5. No Guarantee of Outcomes

5.1 — HealthWatch makes no warranty, express or implied, that following its meal recommendations will improve, maintain, or avoid worsening your health condition or nutritional status.

5.2 — HealthWatch does not treat, cure, prevent, mitigate, or diagnose any disease, disorder, or medical condition. No statement made by this tool should be construed as a health claim, disease claim, or structure/function claim as defined by the U.S. Federal Trade Commission or the U.S. Food and Drug Administration.

5.3 — Individual nutritional needs vary. A meal that is appropriate for one person may be inappropriate or harmful for another, even with identical health conditions and medications on file.


6. Population Exclusions — High-Risk Groups

6.1 — HealthWatch is intended for use by generally healthy adults seeking general nutritional guidance. It is expressly not intended for, and must not be used by, individuals in the following categories without prior written clearance from a licensed physician: pregnant or breastfeeding individuals; children and adolescents under the age of 18; individuals with organ failure (kidney, liver, cardiac, or otherwise); individuals currently undergoing active cancer treatment, including chemotherapy, radiation, or immunotherapy; individuals with a current or historical diagnosis of an eating disorder; individuals with a documented history of severe food allergies, anaphylaxis, or eosinophilic disorders; individuals who have been placed on a therapeutic or medically prescribed diet by a healthcare provider, including but not limited to renal/dialysis diets, low-FODMAP diets, PKU diets, ketogenic diets for epilepsy, or liver disease diets; post-surgical patients, particularly those who have undergone bariatric surgery, gastrointestinal surgery, or organ transplantation; individuals currently prescribed immunosuppressants, anticoagulants (including warfarin and novel oral anticoagulants), narrow-therapeutic-index medications, or any medication for which dietary restrictions have been specifically communicated by a prescriber or pharmacist.

6.2 — If you fall into any of the above categories and choose to use HealthWatch anyway, you do so entirely at your own risk and in explicit contravention of these Terms.


7. Emergency and Critical Situations

7.1 — HealthWatch is not designed for, and must not be used in, emergency situations. If you are experiencing a medical emergency, call 911 or your local emergency services immediately.

7.2 — HealthWatch has no capability to detect acute conditions, allergic reactions, adverse drug events, or any other time-sensitive medical situation. It will not alert you, notify emergency services, or take any responsive action in such circumstances.

7.3 — Do not delay seeking emergency medical care because of anything displayed by HealthWatch.


8. Data Privacy and Health Information

8.1 — Health and medication data you submit to HealthWatch is processed for the sole purpose of generating meal recommendations. Data is retained only for as long as your account remains active. Upon verified request, HealthWatch will delete your submitted health and medication data within 30 days.

8.2 — HealthWatch is not a HIPAA-covered entity as defined under the Health Insurance Portability and Accountability Act of 1996. The health information you submit to HealthWatch is not protected as Protected Health Information (PHI) under HIPAA. You should not submit information to this tool under the assumption that it carries HIPAA-level legal protections.

8.3 — HealthWatch uses the following third-party services to operate the platform, which may process some or all of the data you submit: OpenFDA API (drug and food interaction data lookup); Anthropic (large language model inference for generating recommendations); cloud infrastructure providers (hosting, storage, and compute).

8.4 — Your health and medication data may be used by HealthWatch in aggregated, de-identified form to improve the platform, including for AI model training purposes, unless you opt out by contacting HealthWatch directly.

8.5 — You have the following rights with respect to your data: the right to access the health and medication data you have submitted; the right to correct inaccurate data; the right to delete your data and account.

8.6 — [⚠️ CONSULT LOCAL COUNSEL — GDPR] If you are located in the European Union or European Economic Area, your health data constitutes a "special category" of personal data under GDPR Article 9. HealthWatch processes this data only on the basis of your explicit consent under Article 9(2)(a). You may withdraw that consent at any time, which will result in deletion of your data and termination of your access to the service.

8.7 — [⚠️ CONSULT LOCAL COUNSEL — CCPA/CPRA] If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including the right to know what personal information is collected, the right to opt out of its sale or sharing, and the right to non-discrimination for exercising your privacy rights. HealthWatch does not sell your personal information.

9. AI and Algorithm Disclosure

9.1 — Meal recommendations generated by HealthWatch are produced by an AI system, specifically a large language model (LLM). Outputs are generated algorithmically and are not reviewed by a human expert before being displayed to you.

9.2 — AI systems, including the model underlying HealthWatch, can produce errors, inconsistencies, and outputs commonly referred to as "hallucinations" — meaning plausible-sounding but factually incorrect information. You should treat all outputs with appropriate skepticism and verify any specific claim with a qualified professional.

9.3 — The AI model used by HealthWatch has a training data cutoff date. Its knowledge of drug interactions, nutritional science, and clinical research may not reflect developments after that cutoff. HealthWatch does not guarantee that its outputs reflect current medical or nutritional consensus.

9.4 — HealthWatch is not cleared or approved by the U.S. Food and Drug Administration as a medical device or as Software as a Medical Device (SaMD). It is not intended to meet the definition of a medical device under applicable law.


10. Limitation of Liability

10.1 — To the maximum extent permitted by applicable law, HealthWatch and its owners, operators, employees, contractors, and licensors are not liable for any damages of any kind arising from your use of this tool, including but not limited to: direct, indirect, incidental, consequential, special, exemplary, or punitive damages.

10.2 — Without limiting the foregoing, HealthWatch expressly excludes liability for: adverse health outcomes of any kind, including injury, illness, or death, arising from following or failing to follow meal recommendations; drug-food interactions that were not detected or flagged by the system; allergic reactions to any recommended food or ingredient; harm resulting from reliance on AI-generated recommendations; loss or corruption of submitted health data.

10.3 — In jurisdictions that do not permit the complete exclusion of liability, HealthWatch's liability is limited to the greatest extent permitted by law. [⚠️ CONSULT LOCAL COUNSEL — some consumer protection statutes prohibit liability caps entirely]

10.4 — Indemnification. You agree to indemnify, defend, and hold harmless HealthWatch and its owners, operators, employees, contractors, and licensors from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of HealthWatch; (b) your violation of these Terms; (c) the inaccuracy or incompleteness of health data you submitted; or (d) your reliance on any output produced by the tool.


11. Intellectual Property

11.1 — The HealthWatch platform, including its recommendation logic, AI prompting architecture, user interface, visual design, and all generated outputs, is the exclusive intellectual property of HealthWatch and is protected by applicable copyright, trade secret, and intellectual property law.

11.2 — You retain ownership of the raw health and medication data you submit. By submitting that data, you grant HealthWatch a limited, non-exclusive license to process it for the purpose of generating your recommendations and, in de-identified and aggregated form, for system improvement purposes.

11.3 — You may not reverse-engineer, reproduce, redistribute, or commercially exploit any part of the HealthWatch platform or its outputs without prior written consent from HealthWatch.


12. Governing Law and Dispute Resolution

12.1 — These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

12.2 — Any dispute, claim, or controversy arising out of or relating to these Terms or your use of HealthWatch will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. By accepting these Terms, you waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration.

12.3 — The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.4 — Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.


13. Regulatory Compliance Statements

13.1 — HealthWatch is not regulated by the FDA as a medical device. It is a general wellness software product and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

13.2 — All health and nutritional representations made by HealthWatch are consistent with the FTC's guidelines for health-related digital products. No disease claims, no implied endorsements by medical authorities, and no unsubstantiated structure/function claims are made.

14. Age and Eligibility

14.1 — You must be at least 18 years of age to use HealthWatch. By creating an account or using the tool, you represent and warrant that you are 18 years of age or older.

14.2 — You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are using HealthWatch on behalf of another person, you represent that you have legal authority to bind that person to these Terms.

14.3 — Use of HealthWatch is void where prohibited by law.


15. Modifications to the Service and These Terms

15.1 — HealthWatch reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice, and without liability to you.

15.2 — HealthWatch may update these Terms at any time. When updated Terms take effect, the "Last Updated" date at the top of this document will be revised and registered users will be notified via in-app notification.

15.3 — Your continued use of HealthWatch after the effective date of any updated Terms constitutes your acceptance of those updated Terms. If you do not agree to the updated Terms, you must stop using the service.


16. Acknowledgment of Understanding

16.1 — Before submitting any health or medication data and receiving recommendations, you will be required to affirmatively confirm, via a checkbox, that you have read and understood this entire disclaimer and these Terms of Service.

16.2 — Specifically, by checking that box you confirm that you understand: HealthWatch does not provide medical advice; no physician-patient relationship is formed through use of this tool; HealthWatch cannot detect all drug-food interactions; you should consult a physician, pharmacist, and/or registered dietitian before acting on any recommendation; AI systems can produce errors, and HealthWatch's outputs are not guaranteed to be accurate or current.

16.3 — If you materially update the health conditions or medications in your profile, HealthWatch will require you to re-confirm your acknowledgment of these Terms before generating new recommendations.


These Terms constitute the entire agreement between you and HealthWatch regarding your use of the platform and supersede all prior agreements or understandings on this subject.
